What Happens in Case of Contract Breach?

Entering into Contracts Between Individuals

Contractual breach, as defined within the scope of the Turkish Code of Obligations, is outlined in Article 1 of the law. Within the legal framework applicable to breaches that result in legal consequences, the transactions between the parties that form the fundamental structure of law are examined. In these lawsuits involving two parties, there is an offeror and an offeree. Individuals have the freedom to terminate the contract and amend its content. The freedom of parties to determine whether a contract is executed formally, verbally, or in writing is among their rights. Parties who determine the form of the contract are also free to determine its content. A breach of contract occurs if any of the parties fails to comply with one or more of the contract terms. In such cases, lawsuits filed with experts such as those specializing in contract law are handled within the scope of the law of obligations.

Occurrence of Contract Breach

In addition to the freedom to enter into contracts or not, individuals also have the freedom to choose the party to whom they will make an offer. Within this scope, there are certain limitations in the law. It is necessary to select parties other than those specified within these limitations. Essentially, contracts are categorized into 4 different types: those aimed at transferring ownership, those aimed at use and benefit, those aimed at performing work, and those aimed at safekeeping. Each of these types is further subdivided. For example, contracts aimed at transferring ownership include barter, donation, and sale contracts. Contracts aimed at use and benefit cover loans, lending for use, and lease agreements. Contracts aimed at performing work include contracts for work, mandate, and services. Contracts aimed at safekeeping are diversified into partnerships, obligations whose outcomes depend on chance and luck, and contracts aimed at providing security or guarantees. If any breach occurs in the contracts made, you can seek your rights by pursuing legal remedies according to the Turkish Law of Obligations.
